ISLAMABAD: Justice Faisal Arab of the Sindh High Court on Thursday recused himself from the three-member special court constituted to try former military ruler Gen (r) Pervez Musharraf for high treason, DawnNews reported.
The three-member court heard the case during which Musharraf's counsel Anwar Mansoor argued over the court's earlier order of the issuing of a non-bailable arrest warrant against his client.
Mansoor told the judges that inclusion of the arrest warrant in the court's order gave the impression that the former military strongman was not appearing before the court on purpose, adding that that was not the case. He said his client had serious reservations against the court's move.
Upon hearing this, chief prosecutor Akram Shaikh began his line of arguments but was interrupted by Mansoor who said that the defence team had objections against Shaikh's appointment as prosecutor, adding that the court had reserved its order over the matter.
He moreover said that Shaikh should not be allowed to argue in court as the defence team had been raising objections against his appointment from day one as well as against the manner in which the proceedings were taking place.
Mansoor further claimed that it was common knowledge in the corridors of the National Assembly and the Senate that Shaikh was tasked with the objective of awarding punishment to Musharraf.
Justice Arab said that submission of an application against the prosecutor's appointment did not mean he should be stopped from arguing in court. The judge added that it was the court's job to make a decision on the matter and if the application was accepted only then could Shaikh be stopped from performing his duties as chief prosecutor.
Subsequently, Justice Arab recused from the court saying that if the defence did not think the judges to be impartial, the country had no shortage of jurists who could be asked to do the job.

ISLAMABAD: Prime Minister Mian Nawaz Sharif on Tuesday approved three judges for the establishment of a special court to try former president Pervez Musharraf for treason.
According to Prime Minister Office, Justice Faisal Arab, Justice Tahira Safdar and Justice Yawar Ali have been called for the special court.
Justice Faisal Arab belongs to Sindh High Court while Justice Yawar Ali is from Lahore High Court. Justice Tahira Safdar belongs to Balochistan High Court.
According to the PM office, Justice Faisal Arab will head the committee.

Courts cannot be firghtened by terrorist attacks: Justice Faisal Arab

ISLAMABAD, March 5 (APP): Justice Faisal Arab, who heads the Special Court trying former president Pervez Musharraf in high teason case, Wednesday observed that courts could not be frightened by terrorist attacks, which worked even during wars. The three-member Special Court resumed hearing of the treason case and ruled that verdict on the two petitions of defence counsel regarding setting up of the special court and biasness of judges would be announced on March 7.
At the outset of proceedings, Ahmed Raza Kasuri, counsel for Pervez Musharraf, submitted a letter of Tehrik-i-Taliban in the court, warning him (Kasuri, Sharifuddin Pirzada and Anwar Mansoor to distance themselves from the case.
He said the special court at the present premises was not safe after Monday’s attack on the district courts in Capital’s F-8 sector. It was difficult for them to plead the case in such circumstances, therefore, the court should be shifted to some secured place, for which a petition had also been filed.
In such security conditions, Musharraf could not appear in the court, he added.
Prosecutor Akram Sheikh argued that his sympathies were with the legal fraternity, but justice could not be delayed for an indefinite period, its wheel should have to run. The courts even kept working during wars. The terror threats should, therefore, be ignored, he added.
Sheikh also quoted Churchill’s quote made during the World War II: “If courts are working properly in England then the country cannot lose war.”
Justice Faisal Arab remarked that judges were facing risk of attacks.In this regard was held with the Law Secretary, Inspector General Police and Chief Commissioner Islamabad, who had assured that foolproof security arrangements had been made to safeguard the Special Court premises.
He said in the wake of threats, the case file could not be closed and dumped in the record room. “We are conscious of our responsibility. If a case comes before a court, it has to be proceeded. We cannot leave our job because life threats.”

میرے خیال میں جب تک تینوں جج اعلان نہیں کردیتے کہ "اے بزدل بھگوڑے! ہم نے تجھے معاف کیا، اب ہم تجھے کچھ نہیں کہیں گے، اپنے بستر سے باہر نکل آؤ!" ۔ تب تک یہ اپنے بستر سے باہر نہیں نکلے گا۔
باقی باتیں چھوڑئیے اس نے اپنے دور میں کیا اچھا کیا اور کیا غلط کیا۔ مگر 85 دن تک ہسپتال میں ایک بوڑھی ، نادار اور بے کس بیوہ کی طرح چھپ کر اس نے کم ہمتی اور بزدلی کی جو مثال قائم کی ہے وہ پوری انسانی تاریخ میں کہیں نہیں ملے گی۔

If Musharraf thinks these courts are biased and he does not want to appear before these courts, then he should openly say that I will not appear before the court, I am a commando, do whatever you can, I will not appear. But rather than he ran away and hid himself in the hospital and some other things he is doing

1. His lawyer Ahmaq Raza Kasuri always keep crying before media and shedding tears that for God sake, let Musharraf meet his mother. (So that he can leave Pakistan by using his mother's name, a really shameful act).

2. In Talkshows and different Interviews, Musharraf's face looks like a widow, who is begging mercy, and his tone is also like a half-dead rat. No one can say that he was a commando, after watching his current interviews.

3. In last 85 days, he did not come out of hospital even for one day. He tried to strengthen this perception that the commando is on the edge of death in the hospital and no one should ask him to appear before the court.

I request the court to kick on the back of this coward, buzdil, darpook and maryal commando and throw him out of Pakistan, otherwise he will die with the fear of courts.

احمق رضا قصوری مشرف کو بتاتا ہے کہ جسٹس فیصل عرب نے سپیشل بنچ سے علیحدگی اختیار کرلی ہے، اب بنچ ٹوٹ گیا ہے۔مشرف کمبل سے تھوڑا سا سر باہر نکال کر پوچھتا ہے۔ "کیا واقعی؟؟"۔

What a great mind you have, what idiotic answers you gave to my questions. According to you Musharraf should follow the Procedure to avoid court hearings and he can not say, I am a commando and I am not satisfied by this court, but he can ran away like a rat and hide himself in the bed of hospital. What a procedure following.

In your second answer you said that Musharraf came to Pakistan voluntarily. Musharraf came because he thought there are small, weak cases, and he can easily face them. But After coming to Pakistan, He admitted that he was not aware of treason case. Here is the video

If he was aware of this case, he will never come. and by the way, suppose he came voluntarily in Pakistan, why he is dying to run away out of Pakistan.

I request the courts to let him go out of Pakistan, otherwise this rat will die in Pakistan. جسٹس فیصل عرب کے بنچ کو چھوڑنے کے بعد مشرف اور احمق رضا کافی دیر تک بھنگڑا ڈالنے کے بعد تھک کر بیڈ پر بیٹھ جاتے ہیں۔ مشرف کا سر احمق رضا قصوری کی گود میں ہے۔ احمق رضا قصوری آہستہ آہستہ مشرف کے بالوں میں انگلیاں پھیررہا ہے، جیسے اسے دلاسہ دینے کی کوشش کررہا ہو۔ کچھ دیر خوشی منانے کے بعد مشرف کے چہرے پر وہی پرانے تفکرات عود آتے ہیں۔
مشرف : (پریشان کن لہجے میں)۔ "احمق: اگرچہ فیصل عرب بنچ سے علیحدہ ہوگیا ہے، مگر مجھے نہیں لگتا یہ لوگ مجھے جانے دیں گے۔ اس کی جگہ کوئی نیا جج آجائے گا، میرا دل ہر وقت انجانے خوف سے دھڑکتا رہتا ہے۔ کہیں یہ مجھے پھانسی نہ دے دیں، احمق مجھے بتاؤ، کہیں مجھے پھانسی تو نہیں ہوجائے گی، میں ابھی مرنا نہیں چاہتا"۔
احمق رضا قصوری:" سرآپ کو کچھ نہیں ہوگا، آپ بس حوصلہ رکھیں، آپ کی یہ حالت دیکھ کر میرے آنسو نکل آتے ہیں، دیکھیں کیا حالت بنا لی ہے آپ نے، اب تو آپ کو دیکھ کر ایسا لگتا ہے جیسے ٹی بی کا مریض ہو"۔
مشرف :"احمق ، میں آج تم سے کچھ مانگنا چاہتا ہوں"۔
احمق رضا قصوری: "مانگئے سر، آپ کے لئے تو میری جان بھی حاضر ہے"۔
مشرف: "احمق، میری جگہ تم پھانسی چڑھ جاؤ، میری جان بچالو، احمق میں مرنا نہیں چاہتا، مجھے بچالو"۔ (مشرف یہ کہہ کر پھوٹ پھوٹ کر رونا شروع کردیتا،مشرف کی آنکھوں سے آنسوؤں کی جھڑی لگ جاتی ہے،احمق رضا قصوری نے ٹشوپیپرز کا ڈبہ پاس رکھا ہوا ہے، وہ مشرف کے آنسو صاف کئے جارہا ہے، اور مشرف روئے جارہا ہے، تھوڑی دیر میں بھیگے ہوئے ٹشو پیپرز کا ڈھیر لگ جاتا ہے۔
مشرف:۔ (امید بھری نظروں سے احمق رضا قصوری کی طرف دیکھتا ہے)۔ "احمق کیا تم میری جگہ پھانسی چڑھو گے؟؟"۔
احمق رضا قصوری (نظریں چراتے ہوئے):"سر یہ آپ کیا کہہ رہے ہیں، اگر میں پھانسی چڑھ گیا تو آپ کا کیس کون لڑے گا؟"۔
مشرف ؛"نہیں احمق ، تم پھانسی چڑھ جاؤ، میری جان بچ جائے گی، میں نے تمہیں زندگی میں اتنا کچھ دیا ہے، تم میری خاطر پھانسی نہیں چڑھ سکتے"۔
احمق رضا قصوری:"سر آپ اس وقت آرام کریں، ہم پھر بات کر لیں گے"۔
مشرف کو یک دم غصہ آجاتا ہے، وہ طیش میں کھڑا ہوجاتا ہے،۔ "احمق ، تم نمک حرام نکلے، تم بے وفا ہو، تم نے ساری عمر میرا نمک کھایا اور جب مجھ پر کڑا وقت آیا تو آنکھیں چرا رہے ہو، دور ہوجاؤ میری نظروں سے"۔
مشرف غصے میں آکر اردگرد سے چیزیں اٹھا کر احمق رضا قصوری کو مارنا شروع کردیتا ہے، احمق رضا قصوری وہیں کھڑا اپنا بچاؤ کرتا رہتا ہے،مشرف نے جب دیکھا کہ احمق رضا قصوری ہل نہیں رہا تو اس نے گردن سے پکڑ کر احمق رضا قصوری کو رکوع کی حالت میں جھکا لیا اور اس پر ٹھڈوں کی بارش کردی، اتنے ٹھڈے کھانے کے بعد احمق رضا قصوری کے اوسان خطا ہوگئے اور وہ کسی پاگل گدھے کی طرح اس کمرے سے نکلا اور تیر کی طرح سیدھا دوڑتا دوڑتا ہسپتال سے باہر نکل گیا۔ مشرف تھوڑی دیر کھڑا ہو کر ہانپتا رہا، پھر اپنے پرانے وفادار بیڈ پر گرگیا اور کمبل اوڑھ کر لیٹ گیا۔​
