Israeli settlements amount to war crime - U.N

Israeli settlements in east Jerusalem and the occupied West Bank amount to a war crime, a U.N. human rights investigator said on Friday, calling on countries to inflict a cost on Israel for its "illegal occupation".

Michael Lynk, U.N. special rapporteur on human rights in the occupied Palestinian territory, was addressing a session of the U.N. Human Rights Council, boycotted by Israel which does not recognise his mandate or cooperate with him.

"Inmy report, I conclude that the Israeli settlements do amount to a war crime," Lynk said.

He said the settlements violate an absolute ban on an occupying power transferring part of its civilian population into an occupied territory, thereby meeting the definition of a war crime under the Rome Statute founding the International Criminal Court (ICC).

"I submit to you that this finding compels the international community ... to make it clear to Israel that its illegal occupation, and its defiance of international law and international opinion, can and will no longer be cost-free," Lynk told the Geneva rights forum.

Many countries consider the settlements a breach of international law. Israel disputes this and cites Biblical and historical connections to the land, as well as security needs.

Israel's mission to the U.N. in Geneva, in a statement to Reuters, rejected Lynk's report as "the latest one-sided and biased report against Israel" and accused him of turning a blind eye to violations committed by the Palestinian Authority and Gaza rulers Hamas.

DEMOLITION

Lynk said Israel's demolition of Bedouin tent dwellings in a village in the West Bank on Wednesday left residents without food or water in the heat of the Jordan Valley, calling it "both unlawful and heartless".

"Progressive seizure of Palestinian lands together with the protection of the settlements is a further consolidation of Israel's de facto annexation of the West Bank," he said.

There are nearly 300 settlements in East Jerusalem and the West Bank, with more than 680,000 Israeli settlers, Lynk said.

The United States, Israel's closest ally which has observer status at the council, did not speak at the council which it accuses of having an anti-Israel bias.

Lotte Knudsen, the European Union's ambassador to the United Nations in Geneva, said the settlements were illegal under international law.

"Such actions as forced transfers, evictions, demolitions, and confiscation of homes will only escalate an already tense environment."

Palestinians want to establish an independent state in the West Bank and Gaza with East Jerusalem as its capital, but the issue of Jewish settlements on land captured by Israel in a 1967 war has long been a stumbling block in the peace process. The last round of peace talks collapsed in 2014.

Even if you accept that Israel "illegally occupies" territory - and I do not, nor do I accept that the Rome Statute created new international law - under the Rome Statute these are "crimes" only for settlements established after 2002, when the RS came into effect.

So you deny there is an illegal occupation by Israel? Citizen X see now I am fighting a Zionist idiot since Mossad forgot to pay me

It's tough to sustain the argument that Israel "illegally occupies" territory that Jews are supposed to "closely settle" under the League of Nations' Mandate of Palestine. U.N. resolutions to the contrary don't have legal force under Article 80 of the U.N. Charter.

Have you ever thought that there are far more clear-cut cases of violations of the Rome Statute by other nations? Would Pakistanis even look for such things if that meant contradicting their political leaders?

Sure they can settle after permanent peace agreement with Palestinians because they also have claim to the same land. Solution is not to settle while the land in question is under dispute. That's why it is illegal

Not at all. The Jews of Israel have a legally sustainable claim to Mandate territory. Those who oppose Israel wield a legally unsustainable allegation: under the Palestine Mandate non-Jews within have no rights to political sovereignty within the territory and never did even before the Mandate, therefore they have no claim.

So what's the purpose of peace talks with Palestinians? Why settle border disputes with future to be Palestinian state under 2 state solution if they have no political sovereignty there?

I suppose that depends on who you ask.

Do you think "border disputes" are the only issues?

Doubtless whether or not there's going to be a "future Palestinian state" is cited as one of the purposes of peace talks by some people.

"...“Arabs need to take responsibility for certain things,” I finally shouted at a friend I’d made in Nablus the third or fourth time he tried to deflect blame from Muslims for Islamic terrorism. “Not everything is America’s fault.” My friend seemed surprised by my vehemence and let the subject drop ‒ obviously I’d reached my saturation point with this nonsense.

"I know a lot of Jewish-Israelis who are willing to share the land with Muslim Palestinians, but for some reason finding a Palestinian who feels the same way was near impossible. Countless Palestinians told me they didn’t have a problem with Jewish people, only with Zionists. They seemed to forget that Jews have been living in Israel for thousands of years, along with Muslims, Christians, Druse, atheists, agnostics and others, more often than not, in harmony. Instead, the vast majority believe that Jews only arrived in Israel in the 20th century and, therefore, don’t belong here.

"Of course, I don’t blame Palestinians for wanting autonomy or for wanting to return to their ancestral homes. It’s a completely natural desire; I know I would feel the same way if something similar happened to my own family. But as long as Western powers and NGOs and progressive people in the US and Europe fail to condemn Palestinian attacks against Israel, the deeper the conflict will grow and the more blood will be shed...

"I’m back in the US now, living on the north side of Chicago in a liberal enclave where most people ‒ including Jews ‒ tend to support the Palestinians’ bid for statehood...

"Personally, I’m no longer convinced it’s such a good idea. If the Palestinians are given their own state in the West Bank, who’s to say they wouldn’t elect Hamas, an Islamist group committed to Israel’s destruction? That’s exactly what happened in Gaza in democratic elections in 2006. Fortunately, Gaza is somewhat isolated, and its geographic isolation ‒ plus the Israeli and Egyptian-imposed blockade ‒ limit the damage the group can do. But having them in control of the West Bank and half of Jerusalem is something Israel obviously doesn’t want. It would be suicide. And no country can be expected to consent to its own destruction.

"So, now, I don’t know what to think. I’m squarely in the center of one of the most polarized issues in the world. I guess, at least, I can say that, no matter how socially unacceptable it was, I was willing to change my mind.

"If only more people would do the same."
