سپریم کورٹ آف پاکستان میں چیف جسٹس عمر عطاء بندیال نے از خود نوٹس کا فیصلہ سناتے ہوئے کہا ہے کہ پنجاب اور خیبر پختون خوا اسمبلیوں کے انتخابات 90 روز میں ہوں گے۔

فیصلہ 3، 2 سے سنایا گیا،، بنچ کے 2 ممبران نے درخواستوں کے قابل سماعت ہونے پر اعتراض کیا

اختلاف کرنیوالوں میں جسٹس منصور علی شاہ اور جسٹس جمال مندوخیل شامل تھے۔

اختلافی نوٹ میں کہا گیا کہ ہائیکورٹس3 روز کے اندر کیس کا فیصلہ کریں،آرٹیکل 184 تین کے تحت یہ کیس قابل سماعت نہیں، ہائیکورٹس میں اسی طرح کا کیس زیر سماعت ہے۔

اختلافی نوٹ میں کہا گیا کہ کو جسٹس یحییٰ آفریدی اور اطہرمن اللہ نے جو نوٹ دیا اس پر ہم مطمئن ہیں، سپریم کورٹ کی ایسی مداخلت صوبائی خود مختاری میں مداخلت ہے

جسٹس منصور علی شاہ نے کہا کہ میرے تحفظات ہیں لیکن میری ذمہ داری ہے لہذا بینچ پر بیٹھوں گا۔90روز میں انتخابات کرانے کی درخواستیں مسترد کی جاتی ہیں۔پہلے سےموجود درخواستوں کو جلدی سننے کی کوشش کی گئی

ججز کے اختلافی نوٹ کے مطابق ظہور الہٰی اور بے نظیر بھٹو کیس کے فیصلے اس بارے میں واضح ہی، منظور الہٰی اور بے نظیر کیس کے مطابق از خود نوٹس لینا نہیں بنتا،

اختلاف کرنیوالے ججز نے اپنے اختلافی نوٹ میں کہا کہ سپریم کورٹ ایپکس کورٹ ہے، اسے ان معاملات میں مداخلت نہیں کرنی چاہئے، ایسا کرنا صوبائی خود مختاری میں مداخلت ہے۔
