Correction, he was disqualified to hide a pay which he never took. if he did not receive a pay, how can he declare? You go to an accountant and ask him I want to declare an income which I did not receive. He will look at you and will say are you crazy?
Technically he had to declare these receivables.
Now Let's look at an example:
(1) If you are running a sole proprietorship where you sell raw material to industry. Your sales terms are, the running month+30 days payment. Your total sales for 2020 are 300 million rupees. Out of this total revenue of 300 million, 40 million are still outstanding and noted as receivables. In this case, you yourself have allowed your customers a credit line.
Now when you prepare your annual report, you will be taxed for 300 million in revenue minus expenses and not the 260 million that has been received. And you will declare your receivables as an asset.
Your statement that the accountant will look at you as if you were crazy while trying to declare a not-yet-received income, is false. Actually, if I was a third-party accountant/auditor on your business, I would report you to the tax authorities for unlawfulness if you did not declare it.
Awan bhai, as you may know, I have been running a financial consultancy and accountancy in a European country for the last 30 years, and let me tell you that all incomes are taxable in the year of transaction of goods and services (sales; when invoiced and the ownership changes, for services; when performed and billed) regardless of payment dates. And the receivables would be added to your current assets.
.
Sure, it was a political decision otherwise who cares about such things in Pakistan especially when the defendant is a three times king of Pakistan. But technically the court decision is exactly as it should be.
