Not only is Pakistan violating its international obligations, jeopardising Pakistan's interests and diplomatic standing, the States blind desire to punish PTI is forcing the State to take actions that will cause us long term damage as it erodes our own systems and laws.
The sentencing of 25 civilians by a military court is inconsistent with Pakistan's laws and constitution. Post APS massacre, the constitution was amended to allow the trial of TTP terrorists in military courts (a time barred clause that has since lapsed) fast forward to 2024 civilians are being tried in military courts with out changes in legislation.
No chargesheet has been shared with the public for these 25 nor have any details of their trial been brought forward.
What evidence was available, why were some awarded ten year sentences others 3 or 2 no reasons given and no evidence shared because military courts are not required to issue judgements detailing reasons or share their proceedings with the public. Precisely why civilians cannot be tried in military courts.
The (discarded) Constitution of Pakistan safeguards these rights under
10-A, grants every citizen a right to fair trial "Aperson shall have the right to a fair trial and due process for the determination of his civil rights and obligations or in any criminal charge against him"
While Article 175 (3) makes clear the separation of powers, setting boundaries for institutions and establishes independence of judiciary from executive control "The Judiciary shall be separated progressively from the Executive within fourteen years from the commencing day"
Dismantling one's own laws and constitutional safeguards in order to extract revenge from a political party has never proven to be a wise choice. History will teach you that.
