A battalion of army grabs 3500 acres of land and seals the centuries-old grave yard

A battalion of the Pakistan Army has grabbed the land of old villages of the coastal area of Karachi, the capital of Sindh province. The fisher folk have been forced out of their ancestor villages and pressurised to leave the area. In a latest event Battalion 42 of army, stationed at Karachi, has grabbed the land of the centuries old grave yard of Chashma goth along the Rehrhi coastal line.

The fishermen, whose ancestors are buried there have been prevented from burying their loved ones or even visiting the existing graves which is a ritual for Muslims. On March 18, when the body of fisher man, Abdullah Khaskheli, was brought by the fisher folks for burial the army officials stopped the ceremony. The army officials announced that the grave yard was now under their jurisdiction and no one was allowed to bury bodies. The army has also sealed the graves by putting earth walls around the graveyard.

The protestors then went to Karachi Press Club, 20 kilometers away from their villages, and held a protest. The police contingents arrived to stop the protest and the station head officer (SHO) Mr. Syed Hassan Zulfiqar told the protestor that police cannot intervene in matters of the army. The police dispersed the protest. However, the fishermen are continuing to protest and they have decided to resist the land grabbing by the Pakistan army.

According to Pakistan Fishefolk Forum, a representative body of the fisher folk, the Battalion 42 has till now grabbed of 3500 acres of land from Rehrhi, Landhi town to Ibrahim Hyderi, Korangi. The Chashma Goth grave yard comes in between the areas. The battalion is stationed at Malir Cantonment which is far away from the grabbed land. The soldiers also prevented the fisher folks fishing in the area coming under the grabbed land. The Pakistan army has already a bad record of stopping the fisher men for fishing. As the army encroaches on the land of revenue board the fisher men and their settlements are retrenched from the occupied land.

The land in question was the property of revenue board and is referred in the record as the No Class (or Na class) land. This land was supposedly for the use of fishermen who have live in small villages for centuries. The Pakistan army claims that the land was given as a gift to the army when Second World War was over and Britain left the country. But the army could not produce any evidence to prove that this was true. The actual position is that the land of Malir Cantonment was given to army which is far away from the land which it has been grabbing for a decade. The army actions can not be challenged in the courts because of national security.

The Defence Housing Authority in Karachi has stopped the fisher men to use their centuries old route for fishing. Please see the following link, http://www.ahrchk.net/ua/mainfile.php/2008/2914/, wherein officers of a military residential area, the Defence Housing Authority (DHA), have stopped the local inhabitants from fishing in the areas close to the DHA, burned the boats, fishing nets, and their cycles, the only source of communication for fishermen, and barred them from using their ancestral jetty, in the name of beautification of the military residential area. The Sindh provincial government remains silent spectators.

The Defence Housing Authority was formed in 1980 by the military dictator, General Zia ul Haq. Prior to this the DHA was a housing society under the Sindh provincial government and residential land was acquired at throw away prices in the early 1970s, which incidentally have not yet been paid by the military. General Zia transformed the society into an Authority by a simple ordinance and made it a supra constitutional body, which does not come under the constitution of the Pakistan. No civil law can be applied on the DHA.

After becoming a supra constitutional body in the name of security of the country the DHA has started reclaiming the land all around its territories. It has acquired vast areas of the sea by landfills thereby destroying several centuries old fishing villages. The army has built recreation clubs, golf clubs, hotels, and commercialized the areas reclaimed. The fishermen have been left with nothing and deprived of their basic right to life and livelihood.

The DHA has even bulldozed their graveyards and built commercial structures on them. At present the fishermen have to hire a bus at the cost of Rs. 3,000 (USD 44) to take the bodies of deceased relatives to the nearest graveyard. For that, they get financial help from different trusts and welfare organizations. All this was done to create an atmosphere which could render them helpless, hopeless and compel them to flee their centuries old villages and vacate the land for further construction of palaces for military elite and other rich people.

The Sindh government is a silent spectator to the land grabbing by the powerful army men. It cannot challenge the illegal way of land grabbing by the army because of political expediency and it feels that if army is stopped then it would be difficult for the civilian government to survive.

It is the responsibility of the provincial government and revenue board to stop the land grabbing by the powerful institution in the name of national security. The government should provide the centuries old villages and their land for the safety of the fisher folks and their employment. The right to shelter of the indigenous people be respected by the authorities and the officers who are responsible of land grabbing should be prosecuted according to the law of land.

oh boy! another RAW funded site. the AHRC has forgotten the people living in boats in HK, head quarters of drug trafficcing.

Its our land, our army, why is AHRC so concerned. Why are they not concerned of the RAW trained terrorists that are killing our people. Ah but they womt, cus RAW is paying them to write this.

If the army needs to set up a base to protect the land from Indian terorr or possible future attack, so be it. Its their job to protect us. Karach with huge population and new headquarter of the RAW trained talibans does not enough bases to dend of any Indian attacks. We need thta base, if this news is true.....

AHCRC stands for asian human rights commision, and it points out all human rights violations in asia, and believe me it does not leave out ones in india, How easy it is for us to forget AHRC so quickly when 10 years ago before ourt army went on a murder pakistani campaign, we always used to quote it regarding the kashmir issue.

A young deaf domestic helper disappears from the home of an army official

According to information provided by the victims mother and the Star Welfare Organisation, an NGO, Miss Muqaddas Bibi, a deaf domestic helper in her teens (pictured left with her mother), was working for the sons of Makhdoom Abdul Hameed Mian Mohammad Anwer Makhdoom, Mian Mohammad Saeed Makhdoom and Mian Mohammad Naveed a local landlord and influential politico-religious person, for three years. In 2006, when she was 17, she was relieved from duty. A few months later the Makhdoom family asked that she spend three days preparing for a marriage ceremony at their house, and she has not been heard from since.

The girl's mother, Ameeran Bibi, was told that her daughter had been sent about 100km away to Multan, to work for Makhdoom Abdul Hameed' daughter Javeria Shah, and her husband Nasir Shah who is a Lieutenant Colonel in the Pakistan army. At this time Muqaddas Bibi was still a minor. Her mother reports being refused the contact details of the Shahs and being told nothing further. Officers at Laksiyyan police station told the girl's parents that they had no reason to worry, since the Makhdoom family is respected within the religious community.

After one year her parents report that they tried to file an official police complaint, but that it was rejected by the Station Head Officer (SHO), Mr. Umer Hayat. He allegedly told them that the family is too powerful to take action against.

Ameeran Bibi was unable to pay the fees required by a lawyer, so she filed a case against the Makhdoom family in the courts of Kot Momin with the help of the tradesman who specialise in writing applications. Laksiyyan police officials responded with statements, as seen here, (sent to various authorities and courts, among them the district police officer and the Nazim, or head of the local council) claiming that there was insufficient evidence for a case against the Makhdoom family.

On 27 September 2007 the Court of Peace and Justice ordered the District Police Officer of Sargodha to file a missing person report. This was not done, and although the accused were taken in for questioning by Deputy Superintendent of Police (DSP) Hameed Ullah Rokri, they were released shortly afterwards without charge. Ameeran Bibi then filed an application to the District Sessions Court Sargodha in complaint. In the same application she claimed that the DSP had prevented the SHO of Lakhsian police station, another local station, from investigating the case. On 29 July 2009, the Chief Minister of Punjab ordered the district police to file the case, and finally, they did so.

In response to queries by the AHRC, the DSP says that he personally went to Multan and spoke to the suspected Lieutenant Colonel Nasir Shah about the whereabouts of Miss Muqaddas, and was told that she had been working at his house as a domestic helper but had run away. He claims that he is satisfied by this explanation. When the AHRC asked the DSP why the army officer did not report her disappearance to the police, the question was ignored.

It is sadly commonplace for this kind of case involving a poor victim and alleged perpetrators with money and military links to be kept from court for three years. The AHRC has issued numerous cases in which a military connection has guarantees impunity, among them: UAC-172-2009, UAC-039-2009 and UAC-003-2009.

The lack of investigation into Muqaddas Bibi's disappearance shows how easily a victim or their family can be kept from the complaints process, and how open and pervasive corruption has become in Pakistan. Even the courts appear powerless when faced with a wealthy, prestigious suspect. After three years and various threats many victims give up.

Since the incident Ameeran Bibi has left her home and is staying at a shelter house with her three remaining daughters due to her fear of further threats from the Makhdooms; her husband has reportedlybecome mentally unstable and lives as a vagrant who asks strangers for the whereabouts of his daughter. We are told that the latest offer from the accused Makhdooms through the police is Rs50,000 (USD 625) and two acres of agricultural land.

SUGGESTED ACTION:

Please write to the authorities listed below requesting a thorough investigation into the negligent police officials and the alleged perpetrators, including Lieutenant Colonel Nasir Shah.

The Asian Human Rights Commission has written to the Chairpersons of the UN Working Group on Enforced or Involuntary Disappearances and the Committee on the Rights of the Child, calling for their intervention into this case.

I am writing to voice my deep concern regarding the lack of investigation into the three year disappearance of a young, deaf domestic helper.

I call for a thorough, credible investigation to be made into the whereabouts of Ms. Muqaddas Bibi and the circumstances surrounding her disappearance, with a view of ensuring her safe recovery. Should this not be possible, a murder investigation must be launched. The allegations of bribery and corruption of police officers by the Makhdoom warrant serious attention and legal action.

could someone please tell me why the two threads were merged. because neither were they similar nor were they regarding the same issue, neither were regarding the same person. than why were they merged. If this site has a 100% tollerence to military illegal activities please let me know. I wont post anything like this again. but please dont do this kind of stuff just to try to hide the real face of our army.
