ISLAMABAD: Upholding a decision of the Lahore High Court Election Tribunal, the Supreme Court on Tuesday dismissed former PML-N Punjab Assembly Member Rizwan Gills appeal filed against his disqualification for possessing a fake bachelors degree.
A three-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Ghulam Rabbani and Justice Khalilur Rehman Ramday issued directions to the Election Commission of Pakistan authorities to initiate criminal proceedings under charges of forgery against the former parliamentarian.
Gill had submitted an affidavit bearing forged signatures to prove the authenticity of his fake degree.
The bench imposed a fine on him and noted in its order that a precedent already existed on the issue that a returning officer should take extra care so that ineligible people should not enter parliament.
Earlier, the petitioner did not satisfy the benchs queries regarding his academic qualification.
The chief justice remarked that he had committed a fraud.
Justice Ramday said he felt ashamed that such people got a chance to be in the assemblies.
The defendants lawyer, Muhammad Akram Sheikh, said these were mere allegations against his client.
On May 28, a Lahore High Court Election Tribunal had disqualified Gill for having a fake degree and ordered registration of a case against him and the person who appeared in his place in the BA/BSC examination held under the Punjab University.
LHC Justice Azmat Saeed also reserved the judgement on the petition of the runner-up candidate, Dr Nadia Aziz of the PPP, who had challenged Gills educational qualifications.
