KARACHI: The Anti-Terrorist Court issued non-bailable arrest warrants against former police chief of Rawalpindi Saud Aziz and former SP Rawal Town Khurram Shahzad in the Benazir Bhutto murder case, DawnNews reported.
The court has summoned Aziz and Shahzad to appear in the cases upcoming hearing on December 11.
The lawyer representing the two had earlier requested the court to absolve his clients from appearing in court.
The lawyer had argued that since Aziz and Shahzad were declared innocent during a previous FIA investigation, the court could excuse them from appearing.
The court however rejected the application and issued non-bailable arrest warrants for the Aziz and Shahzad.

Pakistan police face arrest over Benazir Bhutto murder

_50302732_004917087-1.jpg

The assassination of Benazir Bhutto - moments after this photo was taken - remains shrouded in mystery

An anti-terrorism court in Pakistan has ordered the arrest of two senior police officers accused of negligence in the killing of former PM Benazir Bhutto.
She died in a 2007 gun and suicide attack in the city of Rawalpindi.
A special prosecutor says the officers - who include Rawalpindi's ex-police chief - had failed to make proper arrangements and then ordered the crime scene to be prematurely hosed down.
A UN report released in April said the killing could have been prevented.
The report - the result of a United Nations commission of inquiry - accused the Pakistani authorities of severely hampering the investigation and said no credible inquiry should rule out the possibility of involvement of members of the country's military and security establishment.
The UN report also criticised the Pakistani police's decision to hose down the crime scene, and said its failure to collect and preserve evidence "inflicted irreparable damage to the investigation".
On Sunday an anti-terrorism court issued warrants for the arrest of two senior police officers, said special prosecutor Chaudhry Zulfikar Ali.
'Responsible' "The court has issued warrants and these are non-bailable. They can be arrested anytime," he told Reuters news agency.
"I argued that they were responsible for Bhutto's security and they failed to make foolproof security arrangements and they ordered the crime scene to be hosed down despite resistance from other officials."
He named the two as Saud Aziz, the former Rawalpindi police chief, and Khurram Shahzad, one of his deputies. They were not immediately available for comment.
The court will resume proceedings next Saturday.
Ms Bhutto was killed after an election rally, where she was campaigning ahead of parliamentary elections, just weeks after returning from exile.
A government investigation blamed the then supreme commander of the Taliban in Pakistan, Baitullah Mehsud. He denied being involved in the assassination and was killed in a suspected US missile attack in August 2009.
Five militants are already facing trial for alleged involvement in Bhutto's murder.

ISLAMABAD: Police on Wednesday arrested two senior police officers in court for alleged dereliction of duty over the 2007 assassination of former prime minister Benazir Bhutto, a prosecutor said.
Benazir Bhutto was assassinated almost exactly three years ago in a gun and suicide attack after addressing an election campaign rally in Rawalpindi, on December 27, 2007.
In April, a UN panel accused the government of failing to provide Benazir with adequate protection and said investigations were hampered by intelligence agencies and other officials who impeded “an unfettered search for the truth”.
A court in Rawalpindi this month issued warrants for the arrest of Saud Aziz, who was city police chief at the time of the killing, and Khurram Shahzad, another senior policeman for their “failure” to protect Bhutto.
“Both of the police officers have been arrested. The court rejected their application for bail and the judge said ‘this was their duty to carry out the post-mortem’,” special prosecutor Chaudhry Zulfiqar Ali told reporters.
Ali previously accused the officers of being responsible for a controversial decision to hose down the scene of the killing, therefore destroying key evidence, and for failing to provide her with adequate security.
Asked about the charges against the officers on Wednesday he told reporters: “Several other points need to be investigated.”
“Today, the honourable judge rejected their application for bail and ordered their arrest because it was the state’s obligation to carry out a post-mortem.”
According to the prosecutor, the judge rejected as evidence an audio tape in which Benazir’s husband, now President Asif Ali Zardari, apparently asked for the post-mortem not to be carried out.
The court has been adjourned until January 7.
At the time, the government of then military ruler Pervez Musharraf blamed the assassination on Pakistan’s former Taliban chief Baitullah Mehsud, who denied any involvement.
Mehsud was killed in a US drone attack in August 2009, one of the most high-profile casualties of the covert American campaign targeting al Qaeda and its allies in Pakistan’s tribal belt.
Benazir, who served two terms as prime minister, returned from exile two months before she was assassinated, to stand for election.
Zardari led Pakistan People’s Party to election victory in February 2008 and is now the head of state.
After the UN report was published in April, Pakistan removed senior police and intelligence officials from their posts.

Benazir assassination probe being widened

Political observers are of the opinion that it will not by easy to include the former president in the investigation because of his background.—AFP/File photo

ISLAMABAD/RAWALPINDI: The investigation into the assassination of former prime minister Benazir Bhutto is likely to be expanded to unveil some faces, who have so far been out of picture, after two arrested former police officers have told investigators that some intelligence officials were in contact with them on Dec 27, 2007.
In a related development, the interior ministry has sent a questionnaire to former president Pervez Musharraf currently living in London to record his statement.
The Federal Investigation Agency obtained on Thursday six days’ physical custody of former chief of Rawalpindi city police Saud Aziz and SP Khurram Shahzad to recover the cellphones they were using on the day the former prime minister was assassinated in a gun-and-bomb attack outside Rawalpindi’s Liaquat Bagh.
The agency had sought a 12-day remand, but the special judge of Anti-Terrorism Court-III granted six days.
The two former police officers were taken into custody on Wednesday after a trial court hearing the case cancelled their pre-arrest bail.
Special Public Prosecutor Chaudhry Zulfiqar Ali told reporters after the court proceedings that arrested officers had informed the investigators that four officers of the Inter-Services Intelligence and Military Intelligence had been in contact with them.
But he said that their names could not be disclosed now because it was yet to be ascertained in what context they were in contact with the accused.
If concrete evidence was found against the intelligence officers they would be included in the investigation.
The FIA investigators said in the court that forensic tests of the cellphones were needed to ascertain who had been in contact with the two police officers on the day of Benazir’s assassination.
Advocate Zulfiqar said that phone data would help the investigators to know if other elements were also involved in the murder.
He said the police officers had given divergent statements about the cellphones and the numbers used by them three years ago. First they said they had lost the phones and later claimed that these had broken up.
Advocate Malik Muhammad Rafique, the counsel for Saud Aziz, said the cellphone data could be collected from the mobile companies concerned, and not from the police officers. It was surprising, he said, that the investigators had sought the data three years after the incident.
The two police officers were brought to the court without handcuffs in a van with windows covered with newspapers.
QUESTIONNAIRE: “We have sent the questionnaire to Gen Musharraf and are waiting for his reply,” said Advocate Zulfiqar, who is representing FIA’s joint investigation team.
However, political observers are of the opinion that it would not by easy to include the former president in the investigation because of his background.
Prime Minister Yousuf Raza Gilani had a few months ago formed a three-member committee, headed by Cabinet Secretary Chaudhry Abdul Rauf, which excluded from inquiry some top military officials who allegedly ordered the hosing down of the assassination site. The inquiry report, however, has not been made public.
The UN commission on Benazir’s assassination had accused MI’s former director general Maj-Gen Nadeem Ijaz and some top police officials of being behind the hosing down of the site.
The joint investigation team has prepared the 32-point questionnaire for the former president.
Interior ministry sources said the document contained questions relating to security lapse and asked the former president why he did not provide adequate security to Ms Bhutto although she had expressed fears about threats to her life.
Gen (retd) Musharraf’s spokesman Fawad Chaudhry said the former president had nothing to do with the security of Ms Bhutto.
He termed the government’s move to send the questionnaire to Gen Musharraf an attempt to politicise the case and damage him politically.

Benazir murder case: Detained cops name senior army officials

highres_000004021190221211-640x480.jpg

Aziz, Shahzad admit having been in touch with intelligence officers..

RAWALPINDI: Detained ex-police officials of Rawalpindi Saud Aziz and Khurram Shahzad have admitted that they were in contact with four or five high-ranking army officials belonging to Inter Services Intelligence (ISI) and Military Intelligence (MI) during and after the gun-and-bomb attack on Benazir Bhutto, according to public prosecutor Chaudhry Zulfiqar.
Talking to reporters outside the anti-terorism court where the Benazir Bhutto murder case was being heard, Zulfiqar said that the detained police officers had disclosed their names and anyone nominated by them would be included in the investigation.
According to him, the authorities had included 24 important personalities in the murder investigation and he said that their names would be included in the charge-sheet.
Zulfiqar said that the investigation was being run on scientific lines, adding that it was completely transparent.
Pledging to unveil people actually behind the Benazir assassination, he said: “We will not succumb to any administrative or political pressure in this regard.”
Highlighting various legal aspects of the case, he said that according to section 21-A of the Anti-Terrorism Act, the crime scene should have been preserved for at least 15 days, adding that these police officials had washed away the crime scene just one hour and 10 minutes after the assassination.
This was a heinous act and amounted to eliminating important evidence, he said, adding that the local investigators had collected important evidence even after two and a half years of the incident, which were analysed by a modern forensic laboratory in the United States. “The report (in this matter) was made part of the charge-sheet.”
An anti-terrorism court (ATC) handed over on Thursday former city police officer (CPO) Saud Aziz and SP Khurram Shahzad on a six-day physical remand to the Federal Investigation Agency (FIA) in the Benazir Bhutto assassination case.
Both police officials were produced before the ATC whose Judge Rana Nisar Ahmed rejected applications filed by the two officials in which they had urged it to send them to jail.
During the hearing, Public Prosecutor Chaudhary Zulfiqar submitted an application before the court for obtaining their 12-day-long physical remand. The court, however, granted a physical remand of six days.
Accusing the suspects of making false statements, the public prosecutor told the court that the physical remand was important for the recovery of mobile phones used by the police officials, adding that it would help investigators in determining the actual people behind the killing.
Call records, the public prosecutor said, would help investigators ascertain the nature of their communications.
However, Malik Waheed Anjum, the counsel for the detained police officials, told the court that there was no need for the physical remand because both officials had already handed over their mobile phones.
He told the court that this was a murder case and the FIA had no authority to investigate the matter, adding that their further interference would be illegal.
FIA’s joint investigation team was an independent body comprising officials of the Intelligence Bureau (IB) and other departments concerned. Only this body had a legal authority to investigate them, the legal counsel of the police officials told the court.
According to him, anyone nominated by the suspects would be taken into custody.

This is the tradition of our court to humilate civil servant bcz they can,t do any thing, why not full investigations for poor pakistani victims of bomb blast.N0w court should compensate these police officers if they don,t find guilty, its not joke to get cheap popularity make these civil servants scape goats,& then put pressure to give false statement as per desire.
