اب پیغمبر جن کے بارے میں الله سبحان و تعالیٰ فرماتے ہیں کے

جَاءَكُمْ رَسُولٌ مِّنْ أَنفُسِكُمْ عَزِيزٌ عَلَيْهِ مَا عَنِتُّمْ حَرِيصٌ عَلَيْكُم بِالْمُؤْمِنِينَ رَءُوفٌ رَّحِيمٌ ﴿١٢٨﴾
[/HI]تمہارے پاس ایک ایسے پیغمبر تشریف ﻻئے ہیں جو تمہاری جنس سے ہیں جن کو تمہاری مضرت کی بات نہایت گراں گزرتی ہے جو تمہاری منفعت کے بڑے خواہش مند رہتے ہیں ایمان والوں کے ساتھ بڑے ہی شفیق اور مہربان ہیں

[HI]وہ کیسے ایک گناہ پر مسلمان پر سزا کا نفاذ اپنی طرف سے کر سکتے ہیں
جب کے الله کی طرف سے کوئی حکم نہ ھو ؟؟

اور اس کے [HI]بعد دو اولین خلفا [/HI]جن میں سے ایک کی اقتدا میں نبی اے محترم نماز ادا کریں اور
دوسرے کے بارے میں فرمائیں کے
" اگر نبوت باقی ہوتی تو میرے بعد عمر نبی ہوتا"
" اس امّت اور فتنوں کے درمیان دروازہ عمر ہیں"

اب ایسے جللیل ال قدر اشخاص ایک سزا کو اپنی طرف سے نافذ کرتے ہیں یعنی نعوذ بالله
الله اور نبی کی تجویز کردہ حد کو پھلانگتے ہیں

جب کے الله فرماتا ہے کے

وَمَن يَعْصِ اللَّـهَ وَرَسُولَهُ وَيَتَعَدَّ حُدُودَهُ يُدْخِلْهُ نَارًا خَالِدًا فِيهَا وَلَهُ عَذَابٌ مُّهِينٌ ﴿١٤﴾

اور جو شخص اللہ تعالیٰ کی اور اس کے رسول اللہ ﴿صلی اللہ علیہ وسلم﴾ کی نافرمانی کرے اور اس کی مقرره حدوں سے آگے نکلے اسے وه جہنم میں ڈال دے گا
جس میں وه ہمیشہ رہے گا، ایسوں ہی کے لئے رسوا کن عذاب ہے

جب کے یہ اصحاب بلا شک و شبہ ان لوگوں کے سرخیل ہیں جن پر یہ آیات صادق آتی ہے کے

[HI]يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّـهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الْأَمْرِ مِنكُمْ ۖ فَإِن تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّـهِ وَالرَّسُولِ إِن كُنتُمْ تُؤْمِنُونَ بِاللَّـهِ وَالْيَوْمِ الْآخِرِ ۚ ذَٰلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا ﴿٥٩﴾

ے ایمان والو! فرمانبرداری کرو اللہ تعالیٰ کی اور فرمانبرداری کرو رسول (صلی اللہ علیہ وسلم) کی اور تم میں سے اختیار والوں کی۔ پھر اگر

کسی چیز میںختلاف کرو تو اسے لوٹاؤ،اللہ تعالیٰ کی طرف اور رسول کی طرف، اگر تمہیں اللہ تعالیٰ پر اور قیامت کے دن پر ایمان ہے۔ یہ بہت بہتر ہے او باعتبار انجام کے بہت اچھا ہے۔

ثابت یہ ہوتا ہے کے شراب پر حد آپ صل لله ھو علیہ وسلم کی طرف سے تجویز کردہ تھی
نہ کے ابو بکر و عمر رضی الله کا ذاتی انتظامی فیصلہ.

Dear brother watan dost, hudood basically mean set limits. Allah want us to be peaceful people and try to ensure peace for others. For this purpose he set for us terms and conditions, rights and responsibilities, rules and regulations or simply guidlines. commandments ie dos and don'ts were necessary because if certain things people do not do then they cannot attain peace and likewise if certain things they do then again peace cannot be achieved. Likewise not all laws were given in the quran instead some rules can be derived from the quran to add further laws to what is their according to set rules as and when needs arise for us to have those rules. For example, we are commanded to ensure freedom, justice, fairness, compassion, brotherhood, progress and prosperity so that mankind could be in peace. At the same time we are told not to allow oppression, suppression, injustice, unfairness, cruelty, animosity, regression, stagnation and poverty of various kinds because if we did allow any of these then again we will not be able to have peace. Thus quran sets limits in various way about different things. Running a human society not only depends on permanent values but also on things people come with or come across various things from time to time eg once upon a time there were no cars and plans so there were no roads nor laws about roads. However as cars came about and plans then related laws became necessary in order to regulate society about these things. This is why there is a divide between set limits in the quran and limits people set in order to run their society smoothly. Just as there are limits set by Allah and limits set by society itself within set limits of Allah so there are penalties set by Allah and penalties set by society itself to ensure people obey laws. The purpose of penalty is not to punish people till they obey law but to prepare people to realise the importance of an organised society because that makes life easy for everyone part of that society. You cannot control people merely by punishments no matter how harsh. It has to be carrot and stick ie people need to be educated to realise what is benefit for them in obeying the laws. This is why penalties are mere tokenism to alert people when any of them falls of the track to help the person back on track. For example, you cannot stop a person from drinking if one has become addicted to drink because he no longer has control over his problem. It is because certain chemicals alter chemistry of the brain cells in such a way that person develops craving for it. The brain mechanism becomes so affected. So punishing such a person is actually inflicting cruelty on such a person who need medical attention.

This is why if a person kills some one before we bring him to justice we need to ensure the person is mentally fit to stand trial. The mitigating circumstances as well as personal circumstances must be taken in to account etc etc. This is why some things comes from quran as basis but other come from people themselves as they suit them and an amalgamation of both is termed shariah or islamic law. Even though quran is free from any mistake but people are not so when they deduce laws from the quran they may make mistakes and likewise when they make laws based upon quranic rules they may make mistakes and when they apply laws they may also make mistakes. In each case benefit of the doubt must always be given to the party that may have ended up on the receiving end if mistake was not discovered in time.

This is why just reading a penalty in a hadith book and thinking it is the law is not right because the law actually needs to be worked out from that if need be. Laws brought about by the prophet were example for followers in the sense that if they need laws then they too can form laws in a similar way. Those law would however still be useful if the circumstances and situations still remain the same but would not apply if the changes came about with time and circumstances or situations changed. It is not a valid reason on its own that a law was brought in by a prophet. What is important is why the prophet brought in the law and if that reason is still valid then that law still applies otherwise not. This is clear from the quran that if halaal food is not available then to survive even haraam food becomes halaal. All because changed situation changed the application of law. If law of Allah only applies under certain circumstances and situation then law by prophet cannot be for all circumstances and situation either. This is why blanket statements by people that quran and hadith laws apply are not helpful and confuse because a person reads the verse or hadith and starts acting upon it not knowing how it is supposed to be worked out.

The main example of this is everyone says follow quran and sunnah and then sunnah becomes each and every word of the prophet and his deed and even his silence. This has caused major divisions in the ummah. All this because we failed to understand the role of the quran and role of the hadith. Role of Allah and role of his messenger. Role of Allah and role of people.

Dear brother watandost, aap qanoon banaane ke usool ko samajhne main ghalti kar rehe hen. asal sawaal yeh hai keh jis baat ka hukam quran main nahin hai magar us ki ummat ko zaroorat hai to us ke bare main qanoon kaise banaaya jaaye? is ka jawaab yeh hai keh ummat aisa qanoon baahmi mashware se banaye.

yeh baat to aap bhi jaante hen keh quran koi qawaneen ki fehrist ki kitaab nahin hai aur yahe hal hadith ka hai. isi liye ham ko formula diye gaye hen fehristen nahin. yeh aisa hi hai jaise riyaazi ki kitaab main tamaam mumkina swaalaat hal kar ke nahin diye jaate bas tareeqe bata diye jaate hen aur jab koi sawaal hal karna pade to diye gaye tareeqe ke mutaabiq us ko hal kar liye jaaye.

is main khudaa aur rasool ki nafarmaani is liye nahin hoti kyunkeh yeh tareeqe khudaa aur rasool hi ne to diye hen. is baat ko agar aap samajh jaayen ge to ikhtilaaf khatam ho jaaye ga.

sharaab ki hurmat ki ilat main kalaam hai aur is ke faaide aur nuqsanaat main bhi ikhtilaafe raaye hai. isi liye ummat agar mehsoos kare keh is par tazeer honi chahiye kyunkeh sharaab aik masla ban gayaa hai maashre main to woh tazeer ain qurano sunnat ke mutaabiq hi ho gi. is liye kyunkeh qanoon khudaa aur rasool ke diye ge tareequn ke mutaabi banaaya gaya hai. aap is baat par khoob ghor farmaayen ke asal baat kia hai yani hukam yaa tareeqah. aap ko khud hi pata chal jaaye ga ke asal baat qanoon banaane ka tareeqah hai hukan nahin. hukam to sirf baat samjhaane ke liye misaalan bataaye ge hen jaise riyaazi ki kitaabun main asal baat sawaalaat nahin hote un ke hal karne ke tareeqe hote hen. hal shuda misaalen to formule hi samjhaane ke liye di jaati hen.

Another point to remember is that nothing is good or bad by its existence rather things are there to serve some purpose for some other things. This is why nothing is 100% good not 100% bad. It all depends upon the use of things and that is why all talk has to be about whether they are beneficial or harmful. Not only that but how beneficial and how harmful. All this because some things are beneficial for others in some respects but harmful in other respects and some things are less harmful but more beneficial and vice versa. This is why it not that easy to decide why something is harmful and why something is beneficial. it is just matter of looking at society in case humans and if something is found to be good then let it continue for as long as it is good and if something is causing problems then discontinue it for as long as it is a problem.

This is why no matter what is in the quran and hadith ultimately it all comes down to what human know and how they use or apply it for their own benefit. This is why learning is very much what quran wants people to do so that they could benefit of things more and more. Nothing is useful for any person who is ignorant about it. Not even the quran.

It is precisely because ummah has been becoming more and more ignorant about the real world realities and the quranic teachings that it is getting in to deeper and deeper problems. So it is time for us to change for the betterment of ourselves by studying the real world realities and the quran along with them so that we could benefit from our learning otherwise do what we may in our ignorance, nothing is going to help us.
