ISLAMABAD: Although promulgation of Right to Information (RTI) Ordinance in Khyber-Pakhtunkhwa (KP) has largely gone unnoticed in the media, it is set to become a catalyst for change by practically recognising the people’s right to know through a law considered one of the best in the world.


While majority of the media persons are unaware of the efficacy of an RTI law that breaks the culture of secrecy and ends monopoly of ‘privileged’ journalists, it is equally useful for the public, allowing them to seek out information about anything and of any department run by public money. “The KP RTI Ordinance contains all the features that are vital for a strong RTI law. This is why it scores 143 and is positioned at the top of global RTI rankings,” commented a World Bank expert.


Before discussing the salient features of the RTI Ordinance promulgated in the KP, it is important to understand Pakistan’s position on global level regarding introduction of the laws promoting transparency and curbing corruption. This law existed in only 13 countries just a couple of decades ago, according to a World Bank briefing note. Now is introduced in 90 countries though it differs in effectiveness, depending on the structure and scope of legal framework.


Bangladesh and Nepal followed. Now India stands 2nd in global rating of RTI laws, Bangladesh ranks 15th, Nepal occupies 20th position while Pakistan ranks 76th among 90 countries having RTI laws.


Compared to FOI Ordinance 2002, KP’s RTI Ordinance 2013 is a giant step ahead. The former Ordinance has a limited scope, charges Rs50 for each FOI request, requires a reason for wanting information and a signed affidavit that it will not be used for any other purpose, allows 21 days to respond to FOI requests and has no provision for urgent requests. It has vague, open and extensive exemptions; no provision for a harm test; no protection for whistleblowers; designates the Ombudsman - with only recommendatory powers - to hear complaints; and weaker sanctions for wrongdoers, according a brief of World Bank’s consultant.


Speedy and free provision of information: An applicant does not have to deposit any fee for submitting an information request. One can submit a hand-written application or send email queries to the head of concerned department (later to the Information Officer once designated). Information officers must help citizens in making requests without inquiring about the reason for requesting information. The concerned department is bound to provide information within ten working days.


For matters of life and liberty, information must be provided within two working days.Punishment for officers denying/destroying requested information: Those deliberately refusing to disclose information, or destroying information subject to an RTI request, can be punished with a fine of up to Rs50,000; a prison sentence of up to two years, or both.

Sahibzada Muhammad Khalid was appointed as the Chief Information Commissioner by the government on Friday as the Khyber-Pakhtunkhwa (K-P) Governor signed the Right to Information (RTI) Act 2013, said a notification. The law will make K-P the first province to have implemented the RTI as a law.


Sahibzada Muhammad Khalid, a grade 22 official who resigned from the K-P Public Service Commission earlier this week, has been appointed for three years. This period starts from the date of his taking office as outlined by Section 24 of the RTI Act, read the official statement.


The search committee, which will decide two other ‘commissioners’ was also announced. K-P Chief Secretary Arbab Shahzad will serve as the chairman of the committee. Justice (retd) Abdul Aziz Kundi, University of Engineering and Technology Vice Chancellor Syed Imtaiz Hussain Gillani and Rahimullah Yousafzai were announced as members. K-P Secretary Information will serve as secretary to the committee.


The RTI bill was unanimously passed by the K-P Assembly on October 31 and was sent to the office of Governor Shaukatullah Khan to sign. Speaking to The Express Tribune, Spokesperson for Chief Minister Shiraz Paracha confirmed the governor had signed the act and therefore, appointments had been made.

According to Conflict of Interest Law #COI, attempting or getting personal benefits by misusing your official authorities/powers is a punishable offense in KPK.

KP Ehtesab Commission at hand as assembly passes bill

PESHAWAR: The provincial assembly on Tuesday unanimously passed the much-propagated Khyber Pakhtunkhwa Ehtesab Commission Bill, 2013, which provides for the establishment of a five-member Ehtesab Commission and appointment of a director general for preventing corruption and corrupt practices and to hold accountable all public officeholders for these practices.


Under the Act, within 30 days of the enforcement of the act, the government will take necessary steps to set up as many as Ehtesab courts as may be necessary to ensure expeditious trial of offences under this act with territorial areas as specified by the Peshawar High Court and dispensation of justice within prescribed time as specified by the National Judicial Policy.


“Each court will consist of a judge, being a person who is district and sessions judge or a senior additional district and sessions judge. The government after consultation with the Peshawar High Court will appoint a judge of each court.


“The court will not grant any party more than one adjournment during the pendency of a matter from the filing of reference till its disposal.”


The commissioners will hold office for one non-extendable term of four years. The speaker in consultation with treasury and opposition in the provincial assembly will set up the legislative committee within one month after the commencement of the act. The speaker will chair the legislative committee comprising five members of the House and will evaluate eligible candidates. The Ehtesab Commission has the powers to appoint director general, prosecutor general, and director internal monitoring and public complaints wing for the smooth functioning of the commission and effective discharge of the statutory obligations.




The commission will approve annual budget and regulation required to be made under this act. There will be directorate general of the commission that will comprise information and data processing wing, investigative wing, prosecution, finance and audit, internal and monitoring and human resource wings.

The director general will lead the directorate who will be appointed for a period of non extendable four years.

The DG will cease to hold office if he has been convicted of an offence involving moral turpitude. A person who is a retired government officer in Grade 21/22 or equivalent or is a lawyer eligible to be appointed as a judge of the high court and has served in a leadership position in professional career will be appointed the DG.


The DG or an officer of the commission duly authorised by him may during the course of any inquiry or investigation of an offence under this act. The DG can call any person for the purpose of determining whether there has been any contravention of the provisions of this act or any rule or order made there under.


About financial autonomy of the commission the bill said the remuneration payable to the commissioners, director general, directors, other employees, staff and administrative expenses of the commission will be an expenditure charged upon the provincial consolidate fund.


The DG will be the principal accounting officer of the commission. The Auditor General of Pakistan will audit accounts of the commission.

There will be prosecutor general to be appointed for a period of four years. He will give advices to the commissioners and director general upon such legal matters. He will head the prosecution wing and will be responsible for overseeing the performance of special prosecutors who have been appointed to conduct prosecutions of cases and advocates that have been appointed to institute or define cases, appeals, petitions, applications and all other matters before any court or tribunal. Earlier, provincial Information Minister Shah Farman tabled Provincial Ministers (Salaries, Privileges and Allowances) Ordinance, 2013 seeking increase in house rent of the ministers.

خبر پختوں خوا کی حکومت نے ریکارڈ قانون سازی کی جس کے نتیجے میں صوبے میں آیندہ انے والے
سالوں میں بہت مثبت اثر پڑے گا اور صوبہ بہت ترقی کرے گا . اس تبدیلی کے نتیجے میں دوسرے صوبوں پر بہت پریشر پڑے گا . مگر آفریں ھے پاکستانی میڈیا پر جس کان پر کوئی جوں بھی نہیں رینگی . صوبے کے وزیروں نے اپنی ٦ ماہ کی کارگردی کو ایک پریس کانفرنس میں پیش کیا مگر نیشنل میڈیا نے اسکا ذکر تک نہ کیا. جب تنقید کرنا ھوتا ہے تو تمام قوالی شورو کر دیتیں ھیں مگر تبدیلی کا ذکر کرتے سب کو موت پڑتی ھے . انگلش اخبارات کی تعریف کرنا ھو گی جس نے بہت حد تک صوبے میں ہونے والی تبدلیوں کو رپورٹ کیا

کتنا زھر لگتا ہے ہستا ہوا یہ منحوس بٹ

Overall 15 of 25 bills on the agenda were passed during the year (only one of which was a private member's bill).
Seven adjournment motions were raised to draw attention to matters of urgent public importance, of which three were taken up, and 47 out of 61 CANs on issues such as education, health, tribal affairs and local government were also taken up.
Members submitted 197 questions to conduct the executive's oversight – all of these were starred questions requiring oral answers from the relevant ministers.
A total of 123 of these questions were answered by the ministers. Bringing relevant agenda on the floor of house that is reflective of public and provincial needs, and effective disposal of the same is only possible through extended involvement and commitment of the legislators. This can be measured by such indicators as the number of times the assembly met during the year, duration of the sittings, and the attendance and participation of key figures such as the chief minister, leader of the opposition, and speaker, parliamentary leaders as well as other members. Perhaps another reason for the lack of any landmark legislation or other business in the house is the absence of the chief minister from 39 of the 41 sittings and the leader of the opposition from 23, who might have led the proceedings towards issues of greater significance, being the respective heads of the ruling ANP and the opposition MMAP. Attendance of other parliamentary leaders was also low, with the most number of sittings (21) attended by the PML leader, followed by 20 by the PPPS leader, 16 by the PPPP leader, and five by the PMLN leader.
More than half (56%) of the session time was presided over by the speaker, and 39% by the deputy speaker. On average, each of the 41 sittings was an hour and 20 minutes long, and delayed by 41 minutes.
