Getting Involved in PTI's Insaf Research Wing [ IRW ] By Asad Mahmood and Dr. Sabreena

It is not unreasonable to concern oneself with the security of the nation geographically, but is the sorry state of the social, political and economical wellbeing of our country defensible in any other terms? Battered and bruised from internal failings and external pressures since its zealously annually celebrated creation in 1947, Pakistan remains to date, the blind dishevelled old man grazing and bumping wall to wall in search for the path towards justice, humanity and self esteem. How does one break free from the torrential circles in which we inflict self-entrapment?
We have asked the question, because we have the answer. Winning the elections alone wont make the cut. We need to rebuild the nation and facilitate the efficient functioning of the state through well researched and thought out policies and initiatives. Fellow countrymen, weapons of mass destruction are yesterdays news; we bring to you the weapons of Mass Construction.

Ladies and gentleman, introducing the pen- and the power of ideas. Research. The mere mention of the word launches most of our minds into images of lab coats, spectacles and endless piles of dusty books sat on a neglected book shelf in an ancient library plonked in the middle of nowhere. My friends, we assure you the reality is not so. From the Egyptians to the Greeks to the Romans to our own Islamic Golden Age, it has been through no shortcut that civilisations have developed into what they are today. Evolution has played its part in more than just the biological sense, and evolution of thought followed by process is heavily responsible for the manmade world in which we live today. Research in this context is the engagement of able, dedicated and appropriate individuals from various fields to work towards the formulation of policies, infrastructure and systematic operations on all fronts throughout the country.
So exactly how is Pakistan Tehreek-e-Insaf (PTI) going to see through this evolution of thought and process, you ask. Well like many other things, weve got it in the bag folks. We just need you to jump on board the sailing ship. Introduction number two for today it gives us great pleasure to bring to you, The Insaf Research Wing (IRW).

The Insaf Research Wing (IRW) was born in 2009 after its founder Ali Hammad Raza saw through the materialisation of a unified platform for thoughts, ideas and suggestions for the party and beyond. Following on from the Insaf Research Wing which is largely made up by overseas Pakistanis, the three Pakistani PTI think tanks in Lahore, Karachi and Islamabad were formed. Amusingly, the IRW was not initially entirely well received. However the wing now has the respected Secretary General Dr Alvi who has taken IRW under his wing providing senior guidance to the team as well as the President of Sindh and Economic and Finance Spokesperson Mr Naeemul Haque. Coupled with the running of the IRW by Asad Mahmood (PTI UK), it has evolved into an international multidimensional think tank graced by professionals from every field working in their spare time, with some members showing exceptional talent.
The aim of the Insaf Research Wing is the application of ideas, knowledge and research to provide recommendations that will become the backbone of future policies of Pakistan Tehreek-e-Insaf. There are many committees within the Insaf Research Wing ranging from elemental categories of education, economics and health to previously little explored disciplines of environment and anti-corruption. There is something for everyone. Stimulating research papers have been completed by dynamic individuals and groups from the think tank , some of which can be found on this website under the Wings section for your reading pleasure and feedback opportunities.

Pakistan Tehreek e Insaf is spreading like wildfire and the atmosphere everywhere is just electric. People are waking up from sleepy suburbs to embrace this new rising and after many years has there been a rumble in the jungle. But Friedrich Engels once said dont mistake motion for action. Our Chairman, with the noblest of intentions needs votes, but more importantly policies; if the base is good, the support will follow. We, the PTI professionals, have to gift these to him and the nation. We need action and we need it now.

So calling all international based professionals from all fields to join the Insaf Research Wing and bring their dynamic ideas to our very special and spacious table. That is exactly what a few PTI supporters and workers did and now their recommendations have formed the core of the infamous 100 day plan revealed by the chairman just days ago.

Tariq Ali once wrote a book called Can Pakistan Survive? the Death of a state in 1983. As Anatol Lieven observes in his latest offering, thats quite a long deathbed scene by any standards. Nothing is more fitting. We seem to have been at the beginning of the end for an awfully long time as so aptly described above, and in this current resurrection of Pakistan we must all play our part.

Constitutional question marks in the electoral politics of Pakistan punctuated with judicial interpretation are perennial. Pakistans legislature rather than redress the issues has always indemnified the wrongs and become the part of the problem.

All military interventions in Pakistan have a distinction of getting legal/constitutional. First, the judiciary legalises the intervention by invoking the Doctrine of Necessity accepted by the eminent international jurists and some Superior Courts from foreign jurisdiction, to fill a political vacuum and bridge the gap. This is followed by elections and an Act of Parliament that indemnifies the entire duration of the intervention to prolong the interests of the elites. This mutual back scratching has a conspiratorial history.As early as the pre partition elections, the political parties that that morphed into elites of Pakistan had to rely on the Election Petition Commissions for settlement of election disputes. Most petitions were ruled in favour of Muslim League. The magistrate Mr. Samuel Martin Burke nullified the Congress/Unionist machinations in at least 17 cases. This gentleman was to later, become the pioneering diplomat of Pakistan and die in wilderness in 2010.This intrigue endemic to Pakistani politics became apparent as early as 11 August 1947, when Jinnahs speech to the Constituent Assembly was effectively blacked out on radio and press. The daily DAWN of Karachi practically a Jinnah publication was the only newspaper that dared to publish it.

This was the first indicator that some forces within the ruling elites were conspiring to set aside Jinnahs vision of Pakistan. Debates between the minority members in the Constituent Assembly including Mr. S P Singha, Jogendra Nath Mandal of East Pakistan and Joshua Fazal Din indicate the sharp divide that began to emerge between Jinnahs Vision and Pakistans first Prime Minister Liaqat Ali.
It was during such heated debates that Jinnah died gasping for fresh air. Schedule Caste Hindus whose representative Mr. Mandal had cast his vote for Pakistan became the target of religious violence in East Pakistan. The atrocities inspired by religious forces bent on redefining the identity of Pakistan led to the exodus of Hindus to India both from East and West Pakistan. By 1950, Jogendra Nath Mandal, who should be counted as a leader of Pakistan movement could take it no more. Thereafter, he lived a political and social outcast for having supported Jinnah. This was the end of the first phase of Jinnahs Utopian Pakistan that never became.It was during the second phase from 1950-58 that the judiciary also became part of this dirty game. The Constituent Assembly was dissolved by the Governor General Mr. Ghulam Mohammad and emergency imposed. The Bengali Speaker of the Assembly Maulvi Tameez Ud Din, against all odds challenged the dissolution in the Sindh High Court.On 9th February 1955 Chief Justice Sir George Constantine of the Sindh High Court heading a full bench, nullified the action by the Governor General. The Federal Government backed by men such as Mian Mumtaz Daultana, Mian Mahmood Ali Kasuri, Makhdoomzada Hassan Mahmood, Sardar Abdur Rashid, Abdus Sattar Peerzada, Mir Rasul Bakhsh Talpur and Ghulam Hussain Somroo went into appeal. On 16[SUP]th [/SUP]May 1955 Chief Justice Mohammad Munir of the Federal Court heading a full bench, overturned the earlier judgment of Justice Constantine. Justice Abu Saleh, Justice Mohammad Akram, Justice Mohammad Sharif and Justice S.A Rahman supported the dissolution. Justice A.R Cornelius came up with a dissenting note declaring the action of Governor General Ghulam Mohammad illegal. It is of interest to note that all those individuals who opposed the dissolution were East Pakistanis, progressive leaguers or Non Muslims. Politicians and judges of Pakistan in the mould of Jinnahs Vision once again lost this round.The stage was thus set for the illegitimate children of opportunity to team with Military to set the course of Pakistans political future. All progressive Muslim Leaguers most significantly, the Progressive Papers Group was branded as traitors.

The second phase of intolerance ended through the Ahmadiya riots and subsequent imposition of Martial Law. Interestingly Ayub Khan who ultimately took over had been adversely reported during the 2[SUP]nd[/SUP] World war in Burma. He had even failed to discharge his duties in escort of refugee convoys at Lahore. Jinnah had ordered his court Martial, a directive that was mysteriously ignored.
On 5[SUP]th[/SUP] July 1977 was another dark day in Pakistans political evolution. In November 1977 Justice Anwar ul Haq heading a nine member bench legalized Zia's intervention under the "law of necessity." Curiously, when the Supreme Court decision appeared, Anwar had inserted a sentence in his own hand writing! These added words gave authority to the Chief Martial Law Administrator to amend the Constitution of Pakistan. When General Zia-ul-Haq promulgated the PCO on 24 March 1981, Justice Dorab Patel refused to take a fresh oath under it. He was also the dissenting judge in the Zulfiqar Ali Bhutto case. Incidentally, once again a Non Muslim!The next military coup faced resistance from some members of the judiciary. On January 26, 2000, 13 Judges of the superior judiciary refused to take oath under the PCO. Chief Justice Irshad Hassan Khan, as author of Zafar Ali Shahs judgment dated May 12, 2000, condoned the military coup on the grounds of the doctrine of necessity. He granted three years to Gen. Musharraf as Chief Executive empowered him to amend the 1973 Constitution and also return to court if needed. Once again the Constitution of Pakistan and the political system were brought onto the dissecting table for reformative surgery at the hands of butchers.Fortunately, this trend of increasing dissenting judges was to see the beginning of the Judicial Activism in Pakistan led by the Chief Justice Ch. Iftikhar and other honourable members of his court. Justice Bhagwandas declared the references against Justice Iftikhar without merit. It is noteworthy that right from 11 August 1947 to date, clear divides have existed between the forces that held on to Jinnahs vision and justice versus the forces that conspired and upset the system repeatedly in contravention.It is also to note that till 2000, only the Non Muslim judges upheld the ends of justice. It was after this that the tide began to change its course.Curiously, despite repeated exploitations of the Doctrine of Necessity, the judiciary never took it upon itself to ensure that the ends of justice so enunciated were met.

They permitted political stagnancy.
Secondly, all democratic regimes in eagerness to get into the corridors of power, condoned and provided constitutional indemnities to treacherous acts, implying that they too became a party to sacrilege. Hence, both are guilty of decimating and defiling the body of Jinnahs Pakistan.I have always argued that however belated, it is the responsibility of the independent Judiciary to redress this deformity. A beginning can be made through implementation of the Supreme Court Judgement on the NRO case or any point that the legal experts deem fit under the question of law. Thereafter the Supreme Court must review all decisions beginning Justice Munir and remove forever, this daemon from the system. It is also the duty of all executive organs of the state including the executive to support all orders of the apex court.If this does not happen, be assured that Pakistan is headed on a disastrous course. All revolutions have a history of being hijacked.

huzuri bagh my foot with how much security .ns is just doing uchal kood no body knows him in the other 3 provinces ,they dont care ,they are well settled in uk and every where else .its just a part time fun ,u know when u have lots of money u need some thing to do .other rhing they cant go against the wishes of their masters otherwise tomorrow u will see all the scandal and their true corruption stories in western media.

PML(N) helpless to bring change News Desk LAHORE: The PML-N responded in detail to a news analysis by Ansar Abbasi, published on Wednesday. In a letter sent to Mr Abbasi, PML-N Senator Pervaiz Rashid said: According to the views expressed you consider that while Nawaz Sharif rates Mr. Zardari and Gilani regime as most corrupt and incompetent but when it comes to taking any steps he strangely appears to be an impediment in the way. In democratic system the way to change is through in-house change. You are quite well aware that in the 342-member house of National Assembly, PML-N enjoys the strength of 93 members. With this number can you kindly explain, in what way according to parliamentary norms, has our party defaulted? PPP with strength of 127 members has had to cope up with the help and tantrums of some other parties with a view to retaining its majority. In order to do so they have to also face continued bargaining and blackmailing tactics of these parties and groups. Supposedly if, the PML-N was to acquire a majority with its present strength to seek and support of some other parties and groups in the house, how do you think it can effectively function while constantly embroiled with unending demands of other supporters and undertake their avowed building goals and programmes? The present hide and seek game being played by the MQM is a case in point. Only six weeks ago they had parted company with the ruling party leaving both the federal and provincial governments and recalling their Governor in Sindh. The PML-N had made an effort to contact them to strengthen the role of opposition. But before any headway could be made the result is before you all. In yet another topsy-turvy move, that party changed its course, their Governor staging a comeback and reportedly their return to federal and provincial cabinets respectively shortly appearing imminent. You may also consider the consequences of any other stipulated move to remove the present Zardari-Gilani regime, which could possibly give it the status of Shaheed. While disregarding any such strategy it would be proper to let this regime get thoroughly exposed for its rampant corruption, poor governance, cronyism and complete lack of transparency before the nation. It would deprive them once for all of any chance to claim the status of shaheed and victimisation as per their past tradition. Dear brother! Democracy has its own ways, traditions and compulsions. One has to put up with unpalatable and unbearable things some time and wait for the opportune time for a democratic change as per constitutional and democratic norms. Labour party ruled Britain for 12 years facing widespread and strong opposition to its policies on Iraq and even facing a massive million march. But finally the change came through the polls. The change in our next-door neighbour India, also come through polls and constitutional way. You have referred to some Jati Umra meeting in which, according to you Nawaz Sharif had hit the table hard with his clenched fist saying: We shall in no way destabilise the system. I personally dont recall any such meeting. It is possible that your information is reliable. But not only most of party workers but even vast majority of national circles firmly believe that any change through unconstitutional means is unacceptable and must come through democratic, constitutional method. Any deviation would be strongly and widely resisted in the country. According to you, Nawaz Sharif is the obstacle in the path of change. But you have simply overlooked or are not interested to look at the main focus of his real opposition. These were the departure of a dictator, and unconstitutional indemnity of his actions in the Parliament. In Pakistan such a practice has been a tradition from Ayub Khan to Zia-ul-Haq. Musharrafs action on October 12, and the unfortunate act of indemnity by the House in 2002, his unconstitutional action on November 3, 2007, (2nd PCO) and removal of Chief Justice and six senior judiciary members were all unfortunate and unacceptable. Only Nawaz Sharif has stood in the way of endorsement of Parliament to the above actions. This is a new example in the history of Pakistan and Inshallah whenever a real democratic government will be established it will definitely make the dictator accountable for his November 3, actions. This is the firm belief of Nawaz Sharif and the party he has been leading. If besides Nawaz Sharif, there is any other obstacle to the ineffective Ehtesab Bill to NRO in the Parliament, you may kindly let us know. Nawaz Sharifs bold and courageous stand on the Kerry Lugar Bill deeply reflects national sentiments and is now part of history. In the 18th Amendment, Nawaz Sharifs persistent demand ensured Chief Justices effective role in the Judicial Commission. His consequent nomination and the consequent addition of another judge, on the insistence of Chief Justice was another example to illustrate the above point. Nobody can deny the role being played by Nawaz Sharif in strengthening the judiciary after the ruling party had conveniently deviated from the Bhurban Agreement, and the PML-N walked out of the Federal Cabinet, leaving 13 important portfolios. The role of PML-N and Nawaz Sharif and their unshakable commitment towards an independent judiciary needs no further proof. In the aftermath of May 2 Abbotabad incident, approval of a unanimous resolution in the Parliament and appointment of high-level inquiry commission, opposition and reviewing Pakistans role in the war of terror, all are indicative of the strong role being played Nawaz Sharif and PML-N and the role being played by those surfaced through NRO deal of Musharraf and those now gathered in the Federal Cabinet belonging to PML(Q), PPP, MQM, ANP and others is quite evident. Who else other than Nawaz Sharif is a standing obstacle to this motley collection? Quite apart from aversion to Zardari-Gilani regime, and urge to change it quickly, if there is any other method to bring about the above desirable change, according to strict constitutional way, which you can come up with, do let us know please, As also, your assessment that the only obstacle in the way of change and removal of Zardari- Gillani regime is Nawaz Sharif and being targeted by you. I hope you will kindly ponder over this issue and reflect on veracity of your earlier views.Note: The PML-N response is a pathetic admission of helplessness.
