Attempts to make judicial matters controversial

ISLAMABAD: The government continued playing political games to its benefit and making the judiciary controversial. A notification was issued to form a probe commission to be headed by Justice Saqib Nisar but without the required consultation with the Chief Justice of Pakistan and the proposed judge.

Analysts are of the view that by not consulting with the CJP the government has deliberately tried to politicize the matter. Apparently the decision to form the commission was taken under the pressure of journalists' sit-in but the government was not serious in bring the culprits to the book.

Earlier, a notification was issued to form a five-member inquiry commission to be headed by Supreme Court Judge, Justice Saqib Nisar to investigate the death and kidnapping of journalist Saleem Shahzad.

The commission will establish motives behind kidnapping and killing of Saleem Shahzad, will fix the responsibility suggest ways to avert such incidents in future.

CJ approval required to be part of commission: Justice Nisar

ISLAMABAD: Justice Saqib Nisar said Thursday that the appointment of judges to form a commission is at the discretion of the Chief Justice of Pakistan (CJP), Geo News reported.

Justice Nisar said that the CJP was not consulted over the formation of the commission and his approval is necessary for any judge to head or become member of a commission.

He further added that he was not consulted before being appointed as head of the commission but would be willing to lead it after the CJP’s approval.

According to the notification issued by the government, sitting Supreme Court Judge Justice Saqib Nisar would head the five-member commission tasked to investigate the death and kidnapping of journalist Saleem Shahzad.

Information Minister Firdous Ashiq Awan has made it clear that the investigation into killing of journalist Salim Shahzad will be completed within 6 weeks. She said this while talking to media men here Thursday outside the parliament house. She held that government would not escape by throwing the ball in the court of Chief Justice of Pakistan (CJP). A 5-member commission under Supreme Court judge Justice Saqib Nisar has been constituted to probe into the Salim Shahzad killing case. It will conclude its investigation and recommendations and present the report to government within 6 weeks on this count, she added. It depends on Justice Saqib Nisar either he becomes chairman of the commission or other wise. Awan further said media would monitor all the process of investigation into killing of journalist Salim Shahzad.

If government is not listening to Justice Saqib Nisar what he is saying now then what is the gaurantee that they will implement the findings of his commision's report.

Why this time around CJP requires a proper approach to him ... even if Saqib nisar is appointed CJP can say ok S nisar go ahead and head this commission for the betterment of this nation and find all the facts about the poor journalist...

What are you talking about? Judiciary and executive are two separate independent branches. How can a head of ARY news assign a task to Geo news worker? How is going to do the work assinged to Saqib Nisar?

Journalist’s murder: Justice Saqib Nisar refuses to head commission

Justice Saqib Nisar has refused to head the commission to probe Saleem Shahzad’s murder.


The government has issued the notification of formation of the commission to probe into the murder but the opinion was not sought from the Chief Justice as well as from Justice Nisar.

PML-N has also expressed its dissatisfaction over the commission while Firdous Ashiq Awan said that government’s decision should not be suspected.

According to the notification, the commission comprises Chief Justice Federal Shariat Court Justice Agha Rafique, AIG Investigation Punjab and DIG Islamabad.

On the other hand, Justice Saqib Nisar said that no judge could be nominated for the commission without the approval of the Chief Justice Iftikhar Muhammad Chaudhry.

Talking to Dunya News, Justice Saqib said that the reason behind refusal was nominating him without permission of the department head.
Justice Nisar said that he would head the commission if the Chief Justice approved.

On the other hand, PML-N has also expressed its dissatisfaction over the formation of the commission.

PML-N spokesperson Pervez Rashid said that the nomination of Justice Nisar without CJ’s permission shows non-serious attitude of the government.

Federal Information Minister Firdous Ashiq Awan has assured that they would consult all parties while making an ultimate judgment.
The commission would submit its report within six weeks.
